London Mayor Under Fire as Court Rules LEZ Charges Unlawful (Between 22 Apr 2016 - 17 Jun 2021)

 

Noel Willcox Wins Landmark Case Against Transport for London – Opens the Door for Millions in Refunds

 

London, UK – Noel Willcox, has achieved a groundbreaking legal victory against Transport for London (TfL), exposing a multi-million-pound scandal in the enforcement of Low Emission Zone (LEZ) charges.

 

Willcox, whose company Elevation Access Ltd was wrongly charged £11,500 in LEZ penalties, took his case to the Road Traffic Adjudicator, where he successfully proved that the LEZ scheme was unlawful due to non-compliant signage. The ruling, which TfL never appealed, stated that no charge was lawfully due.

 

Despite this ruling, TfL continued to pursue Willcox for payment and even sought to strike out his claim in County Court. However, on March 20, 2025, the County Court upheld the Adjudicator’s decision, confirming that the LEZ was unenforceable under UK law due to failures in signage compliance with the Traffic Signs Regulations and General Directions (TSRGD) 2016. He has now enforced that decision in the County Court. The story of how he did it and the challenges he has faced must be told.

 

Implications for the London Mayor & TfL

This ruling has far-reaching consequences. Since 2016, TfL has unlawfully charged millions of drivers under the LEZ scheme. If drivers follow Willcox’s legal pathway, TfL may be forced to refund hundreds of millions of pounds in unlawful charges.

 

The decision also raises serious political and legal questions about London Mayor Sadiq Khan, who not only failed to act on these legal failings but expanded the LEZ into the ULEZ, despite evidence that both schemes operate under non-compliant signage.
